lemon law, does my situation qualify?

Tagged Under : , ,

Question by ffff: lemon law, does my situation qualify?
okay.
barely a month ago, 3/13/2010 to be exact, i bought my 97 ford taurus from a certified dealership in dearborn MI
the dealership was selling the car for 2000 dollars, but i talked them into knocking it down a few hundred.
i was at the dealership for a long time checking the car, driving it around, i was going to have a mechanic with me but it was a saturday and there was already another potential buyer coming in to buy it the next day.
now, this “dealership” was more like a piece of crap junkyard that refurbishes cars.
after long discussion, calling of numerous people who know about cars, and asking thorough questions about what could possibly be wrong with this car, the dealers assured me that the car had absolutely nothing wrong with it.
i did know of one thing… the headlights didnt work.
that said, i havent been able to drive at all really. until about 6pm then i head home. and i dont leave the house until 2-3pm. and if i go anywhere, it’s the grocery store or a few places up the road. i have not traveled long distances AT ALL.
a few days after i got the car off the lot, i was sitting in the parking lot of auto zone, because sure enough, the battery died the day i got home with the car.
while i was sitting there, the antifreeze canister exploded, meanwhile on the inside of the car, the hot and cold monitor was at a perfect level in between….
okay, so now we have a coolant problem..
i call the dealer and i say, “look, i know i bought the car and now it’s nothing i can do about it, let me know what the real problem with this car is”
his response
“i didnt really look at the car man we just got it up and running to get off the lot”
and he hung up.
basically admitted to fraudulence.

now, a few weeks after that, and minimal driving because anything longer than 10 minutes on the road the antifreeze explodes, the car is rough! it is rough riding.
i took it to get an analysis at a car shop and here is what all is wrong with it…

rear pads and rotor
struts all the way around
right front sway bar is completely broken to the point if i hit a pothole the tires would be off and i could potentially be killed or someone else could.
right and left inner and outer tire rods
coil
radiator
radiator hose

all of that together, is about 2000-3000 dollars.

and today, i was at the thrift store, and get ready to go home, and the car stops turning over and white smoke came out from the alternator.
and now the alternator is done.

i was just wondering if there is any law that i can get a reimbursement, sue the company, if there is a lemon law against this.

everyone is telling me that the sway bar is a big deal because i am a customer, not a mechanic, i am supposed to trust the dealer in knowing that if i drive the car i am going to be safe. there has to be a law against this fraudulence.
i had no idea any of this was wrong with it, like i said, it drove great off the lot.

please dont be cocky or say any dumb things about ford or how i should have known, i am literally just wondering if there is anything i can do.
i am going t read the laws for myself, but any adivse or knowledge on anyones end can really help.
thank you
to be frank, all of these problems did appear out of nowhere, do you think i am like two tracking in the woods trying to ruin the car to get a lawsuit? i am a college student with 2 jobs and i need as much of a break as i can get, and being a customer how am i supposed to know? i didnt know the headlights didnt work until i went to drive it the night i bought it and i couldnt drive.
and lets forget about the lemon law, say i am not qualified… is there anything i can do to take them to court?
is there a potential case against them, to perchance just get them to fix these things for free, or refund my money, or give me a new car, or something? i am willing to just get the car fixed, with the list of things that are wrong with it for free, they missrepresented the car with the ad and they misrepresented it in person by having a quick excuse to everything we pointed out and having no problem lying to our faces saying there is absolutely nothing wrong with the car. i havent drove but 25 miles if that since i bought the damn thing.

In most states you must take the car to a license mechanic before you purchase the item. If you did not than you cannot claim that the lemon law was violated. If you can prove that they misrepresented the car in any way, you may be able to take it back or have a judge reverse the sale. But if not, then your screwed.

It’s sold AS IS.

Some states has a 7 day policy, meaning if you took it to a mechanic within 7 days then you can declare it a lemon. However, we wouldn’t know this if we don’t know you state.

Question by militarywifey home alone: How do I know which lemon laws might apply to me? We are military and we are Florida residents?
My husband is military, we are Florida residents, we bought the truck in North Carolina, it’s registered in NC but we live in GA. It’s headed back to the dealership today to be repaired for the 3rd time in 3 weeks for the same symptom.

How do I file a Civil Lawsuit?

Tagged Under : , ,

Question by angela w: How do I file a Civil Lawsuit?
What is the process to file a Civil Lawsuit against a company? I bought a car and it is a lemon. Under the NC Lemon Law my car falls under all categories. I have repaired the same thing 4 times and there is no fix for this problem. I have cooperated with the company and dealership to resolve this problem but now the company will not assist me in any way because they know this problem cannot be fixed. Thanks for any advice.

Answer by Voice of Reason
There are two ways:

1. Look in the yellow pages or on the internet for a lemon law lawyer, and hire one. They will be paid out of your recovery.

2. Try to do it yourself and lose.

Take your pick. Good luck!

Dealership sold me a bad car?

Tagged Under : ,

Question by : Dealership sold me a bad car?
I bought an 00 Jetta TDI from a dealership 2 days ago. I took it in for an oil change/tune up etc. The mechanic said the transmission was going bad and needs to be replaced. It slips during initial acceleration, and in 5th gear.

Also, the oil plug was over sized – trying to cover up the stripped threading.

Am I SOL? Do I have any options? I realize only a few states recognize the ‘used car lemon law’ and WA is not one of them. But are there other caveats? Unfair and Deceptive Acts and Practices (UDAP) laws? What am I entitled to with that?

question about used car and Virginia Lemon Law?

Tagged Under : , , , ,

Question by Ally S: question about used car and Virginia Lemon Law?
So here’s my story, I live in Virginia, on NOV 3, 2010 I bought a used car(1994 Ford Taurus SHO) from a used car dealership, “as is”, no warranty. The car kept dying and smoking, so I took it back about 3 times for them to fix it, because the guy said “if anything is wrong, bring it back and we’ll fix it.” On NOV 19, 2010, they kept the car for 2 days, fixing it, and I picked it up on NOV 20, 2010. On NOV 27, 2010, the car completely broke down, battery died, power steering seized up(i think), and when we called the dealership and told them about what happened and if they’d fix it, they said “no we won’t, because we already fixed it.” Also, the dealer did not give me a “buyers guide”. So does my car fall under the Virginia Lemon Law where I can basically take the car back and say give me my money back, since it hasn’t even been a month since I’ve had the car? Or there something else that can help me get my money back? Please help!!! Thank you so much.
the car I bought is not new, it is USED

You bought a 16 year old car without a warranty. You have little claim against the dealer, much less through the states ‘lemon law’.

Fanfiction reccomendations (Harry Potter) [sorry for the re-post]?

Question by In with a Chance (;: Fanfiction reccomendations (Harry Potter) [sorry for the re-post]?
Hello!
Sorry for the re-post but I can’t find any satisfactory Fanfctions online ;\ Writing my own just isn’t the same.
Just a bit of information about what I look for in a Fanfic:
Ships:
Draco/Hermione (Dramione)
Harry/Hermione (Harmony)
Tom Riddle/OC
Neville/OC

Here are my three current favorite Fic’s from Fanfiction.net (It might help you see what I look for)
**All content belongs to their respectful owners

1) Witchcraft by a Picture (By anyavioletta)

http://www.fanfiction.net/s/5316529/1/Wi…

2) Alexander Draco Malfoy (By Aoi Megami)

http://www.fanfiction.net/s/6448137/1/bA…

3) Joint Fixation (By boaluv14)

http://www.fanfiction.net/s/5615591/1/bJ…

A few points that make a story enjoyable (in my opinion)
-Romance
-*some* Lemons (Not a story that’s based on Lemons because that doesn’t really make a story good, in fact, it makes it a bit crappy, just one every now and then that helps develop relationships and/or ruin relationships)
- As close to cannon as possibe (It’s hard with a Tom Riddle romance fic, but anyavioletta made it work quite well, in my opinion.)
-Plot turns, twists, action, adventure… not something that is focussed purely upon romance
- This last point will probably make me sound like a stupid little fangirl, but I love Draco/Hermione Head girl- Head boy Fanfics as well as Hermione/Draco ‘Marriage Law’ fics and those Fics where they have to raise a baby together as part of a new Muggle Studies type class :)

Thank you! I’m sorry if that’s a bit much but what can I say? I’m a perfectionist :P

Help me avoid a possible vehicle scam.?

Tagged Under : , , , ,

Question by The Definition Of A Patriot: Help me avoid a possible vehicle scam.?
I just purchased a vehicle from a second hand dealer and I am now doubting it. The following day that I drive off the lot,my check engine light comes on. Took it to autozone and the tech reads a code p0303 which means cylinder 3 is misfiring the day after it went away. I go back to the dealership And they claim its corroded spark plugs. They claimed to have changed that. The whole situation seems wonky. I’m from MA and the dealer is in CT. The car is not registered and has not been inspected yet. Dealer claims that he will not take the car back out of state. First thing in the morning today I’m gonna call my bank to freeze the check before further actions since its only gonna be the third business day of the check clearing. Do I take the vehicle to an official Lexus dealership to get thorough diagnostics or just take legal action since I already paid, do I have any rights? The lemon law of CT states that the dealership is responsible for fixing the vehicle but the dealers confirmation on claiming to fixing the vehicle seems highly biased so they can avoid hefty fees for a possible serious vehicle problem due to the check engine code. Vehicle was priced at 1000 below compared to a first hand dealership. So assuming the check has been cleared and he has my money, what kind of laws are on my side to get my 17k back?

Best answer:

Answer by mackinawbob
Is the light still on? If it went off, the problem did go away.
Cars that sit around on dealer lots for a few months get a little “sticky;” maybe a piece of dirt in a fuel injector or a dirty spark plug.
You did not specify what year or kind of Lexus you have, but at 17 grand, I’m assuming it is fairly new. If the vehicle has spark plug wires, one of those could be defective; if it has coil on plug direct ignition, a coil could be bad. Neither of these is an expensive fix.

Don’t panic, the thing is probably fine. Unfortunately in the rare instance there is a major problem, there are no lemon laws for used vehicles.

Question by kas: Can anyone tell me about the texas lemon law or give me a good web site to learn more about it?
I bought a new car(2007) in TX and it keeps breaking down I need to know what my rights are. I have already had to bring it back to the dealer twice to get parts replaced

People in Texas have to go to their home court in Oklahoma City to enact the lemon law since every car sold in Texas is theoretically a lemon.

My brand new Car being out of service for more than thirty days due to manufactors defect in the state of AR?

Question by Krissikad5: My brand new Car being out of service for more than thirty days due to manufactors defect in the state of AR?
There was a manufactors defect on the sunroof of my brand new car. The defect caused the car to flood on two seperate occasions. After the first repair attempt failed the second repair attempt has taken well over thirty days and i sent them a final repair attempt letter 10 days ago.i live in the state of Arkansas. My main question is i gave them 30 days to repair they never returned the car to me . so they cant “schedule the final repair attempt”because the car is already there.so did there 10 days start on the day they recieved the letter?Anybody who is a lemon law expert please contact me!!

Answer by nuff said
the lemon law only kicks in if your vehicle is in the shop for repeated repairs. Thi sounds to me like you need to get in touch wth the district manager for that manufacturer. In other words, go over the dealerships head so to speak. Since you vehicle has only been in the shop twice, it would not fall under the lemon law. You will need three trips. heres a link.

Arizona Lemon Law Private Party Question?

Question by : Arizona Lemon Law Private Party Question?
Ok I sold a 93 honda civic and it ran great I got it in a trade. I sold it to these girls who each drove it around I explained that I thought it had an exhaust leak but that I had not training to know for sure. She bought it for 2000 on Feb 25 it is now March 7 and just now shes telling me that the motor blown or somethings really wrong Im not sure. Today I got home and there was a note in the door saying that that they want there money back or they would be going to the police or a layer. Im just wondering ive done some research about it and know that the lemon law only covers from dealerships and I honestly sold them a good car. I also wrote a bill of sale stating that i was selling the car and she was the buyer. Im just wondering to cover my base that this case really wont stand up in court. Any advice would help thanks guys.
so today i got a summon to be at court. I have 20 days to appeal this and give my side which I dont owe her anything if i was getting the running car back id prolly take it back however the engine is blown and the engine is now out of the car. I can also make a counter claim? Does anyone have experince in this? Because i really dont want to lose this case. And she is also stating that i sold her a non working car and said there was nothing wrong with it. SHE DROVE IT HOME.
anyone also got a data point i can print out and show to the judge to show that there is no lemon law for cars that are used and private party just so i can bring proof chances are this judge isnt the greatest.

There is no lemon law that covers used cars, and certainly not cars that are almost 20 years old. They have no case whatsoever.
