What is the process to file a Civil Lawsuit against a company? I bought a car and it is a lemon. Under the NC Lemon Law my car falls under all categories. I have repaired the same thing 4 times and there is no fix for this problem. I have cooperated with the company and dealership to resolve this problem but now the company will not assist me in any way because they know this problem cannot be fixed. Thanks for any advice.

There are two ways:

1. Look in the yellow pages or on the internet for a lemon law lawyer, and hire one. They will be paid out of your recovery.

2. Try to do it yourself and lose.

i purchase this riding lawn mower at big blue in clinton nc! and its only been 4-5 months since i purchase it brand new but it keeps messing up one thing after another! im asking if i can use the lemon law on my riding lawn mower in north carolina!

i bought a 2001 pontaic from a car lot i have not had it 30 days it is falling a part they are not wantting to pay for it to be fixed i pay 8000.00 for this car and it is a lemon car i had it 3 weeks so far as is but dam i would fix it and make it right if i man payed me 8000.00 dollars they told me sorry it is my now but people tell they are a 30 day lemon law in north carolina so can i make them fix this car and not charged me for the repair thanks for any answers

lemon laws only apply to new cars – there should hve been a statement of warranty hanging in the window when yo bought this car – it will either tell you what is covered or say “as is” on the paper in inch high letters

I bought a 2003 Dodge durango from a Buy here-pay here lot 8 DAYS ago. It had 223,000 miles. It came with no warranty. I paid 00 down and payments of a week. This morning the engine locked up and its looking at about 00 to fix!!! Thats about what I owe on it! I have 3 young kids..4 yr old twins and a 1 yr old. This is our family vehicle. I know there’s got to be some kind of laws out there to protect someone in this position!!! We live paycheck to paycheck as it is! What can I do? Any advice would be greatly appreciated.

You bought it. You own it.

Laws ? To protect you from yourself ?

You could have had it checked out. You chose not to.

Ask the dealer if he will forgive the note for giving the truck back. That’s the best you can hope for.

The 00 is gone.

And you legally owe the balance.

I live in NC and I recently heard about something called a lemon law. Is this just for my state, or do all or most states have this law?

It is a state by state situation, like most laws in the United States. I don’t know whether NC has it, but some states certainly do, though the details will vary by the state.

Lemon laws involve a consumer’s right to a refund for a motor vehicle that, despite repreated attempts to fix it, continues to be defective in a significant way.

I bought a house two months ago. My home inspection turned up a few items and the seller fixed those items. In the state of North Carolina, you cannot sue a home inspector. It’s even outlined in the agreement prior to the inspector going out to do the inspection.

This house, though, has been a nightmare! It’s only 16 years old, but I’ve had a pipe burst, insulation pulled and replaced, buckled vinyl flooring replaced, wax ring on the toilet go bad, rotted out the floor, leaks from skylights in the sunroom, faulty wiring, breakers tripping, roof leaking, and this is only after two months.

What’s next? This house is the money pit. I’m a single female, first time home buyer. My dad was right, though sexist, when he said I should’ve gotten married first. Ha!

So is there any relief or alleviation for home owners who have purchased a lemon of a house?

I recently went to North Carolina and purchased a used car for my neice. I had a mechanic go over the car. There were no problems. Now it is a week later and the car is skipping. I called the dealership and told him that either he fix it, replace it, or give my money back. I told him that it had not been 30 days yet. He says that it does not matter because in NC that the lemon law only applies to new cars.Is this true?

Yes. Check your records. Did the dealer give you a warranty or sell it “as is?”
I bought a used vehicle and had a mechanic go over it beforehand. I paid ,000 for it, and in less than five years spent ,000 keeping it on the road. When you buy used, you take a chance.

I have never heard a lemon law in any state that covers buying form an individual. Buyer Beware. The assumption is that a dealer has to be more responsible and therefore potentially liable.
