question about used car and Virginia Lemon Law?

So here’s my story, I live in Virginia, on NOV 3, 2010 I bought a used car(1994 Ford Taurus SHO) from a used car dealership, “as is”, no warranty. The car kept dying and smoking, so I took it back about 3 times for them to fix it, because the guy said “if anything is wrong, bring it back and we’ll fix it.” On NOV 19, 2010, they kept the car for 2 days, fixing it, and I picked it up on NOV 20, 2010. On NOV 27, 2010, the car completely broke down, battery died, power steering seized up(i think), and when we called the dealership and told them about what happened and if they’d fix it, they said “no we won’t, because we already fixed it.” Also, the dealer did not give me a “buyers guide”. So does my car fall under the Virginia Lemon Law where I can basically take the car back and say give me my money back, since it hasn’t even been a month since I’ve had the car? Or there something else that can help me get my money back? Please help!!! Thank you so much.
the car I bought is not new, it is USED

You bought a 16 year old car without a warranty. You have little claim against the dealer, much less through the states ‘lemon law’.

I recently bought a mini-bus. I didn’t even get it 50 miles before it broke down. To date the repairs have cost me almost as much as I paid for the bus. I wanted to know if Virginia have a “lemon” law?

Yes, it does. It covers new cars. I sounds like you have a used, as is, vehicle. If so, read whatever papers you were given when you bought it, if it has any warranty, it will be outlined there.

Is it also true that there is no lemon law? Say I purchase a vehicle and within x amount of days find the car to be less than stated… will I be able to return the vehicle?

It’s common, but you aren’t required to pay it. It’s just profit for the dealer. Tell them you won’t pay it, it’s not mandatory. It’s strange that they have it so high in NoVA when the dealers across the river in MD have it lower. Just remember, you set the terms of the deal and make the final decision; you’re not out to make friends, you’re out to buy a car.

The lights dim periodically for 10 to 20 seconds. Then the engine surge goes down and light brightness increases. Very annoying when driving at night…cars/trucks/cops think I’m flashing them. Taken to the dealer 4 times and they can’t find anything. Coming up on 50,000 miles and it’s been doing it since I bought the car 2 years ago. Also wondering what recourse I have if they can’t fix the problem. Lemon law (Va)? Any comments are much appreciated.

alternator not working properly,intermittent, have it check

of course intermittent problem are always hard to find ,i cant blame the dealer,

the only thing is if they have a problem like that the manufacturer are always willing to help ,so it sound that they never ask for help from the manufacturer

I bought a used sportsbike in early July 2009 from a private seller. With the purchase he wrote me up a 2 month warranty, and his “word” that the bike is fine and will cause no problems. 2 days after purchase, the bike starting making a loud noise, I called the seller to let him listen to the noise and he sent a mechanic out to pick up the bike. I called him later that day and explained to him that I did not feel good about owning a bike that is going to the shop 2 days after buying it,(btw the bike is a 2006 Kawasaki ninja 600, with 17K miles on it) and that I would like to either get my money back or have it exchanged for a more reliable bike that he owns. He insisted that this was a fluke and that nothing would go wrong again with this bike. I should have seeked this legal advice at THAT point, but instead, I took ownership again of the bike…. it rode good for about 3 weeks, then the temp gauge started to show 245 degrees at the end of my rides(which is hot! for a bike) …. again, I took it to the mechanic, and the diagnosis was that the bike was not overheating but, the temp sensor went bad and is giving the wrong readings. The seller once again paid for this repair under the warranty. At this point Im getting uneasy because I see a pattern building. I go pick the bike up(after two weeks of it being in the shop for repair) and THAT SAME DAY, I get to my family cookout turn it off, then come back to start it back up and it made this noise loud as a helicopter landing!!! I called the seller, he didn’t answer, so I left a VM and let him hear the noise that it was making. I called the mechanic that was working on it and he came out to pick the bike up. By this time, the two months have gone by. I spoke to the seller yesterday. His son is currently extremely ill and in the hospital, and you could tell that my bike was the last thing on his mind(understandable), but I am now at this point, bike is broken(again) and this two month warranty has expired.

My beef is this… I live in VA, isnt there a lemon law that can be applied? 3 trips to the mechanic within a 2 month timeframe seems ridiculous….. additionally, wouldnt the doctrine of prommisory estoppel come into play. I really need some advice as to how I should move forward with this.

Lemon Law in all 50 states ONLY applies to NEW vehicles or motorcycles.

However lemon law which only applies to new motorcyles states if it is attempted to be repaired for the exact same problem more than 3 times in the first 12 twelve months it could qualify for the lemon law. Or if bike is out of service more than 30 days in the first 12 months it could qualify for the lemon law. This means the first 12 of the In Service Date- or date it was sold new.

I (first time buyer) bought a car from a shady dealership in VA, where lemon laws on used cars are non existant unless undisclosed problems are acctually safety hazards. The engine had been swapped the intake was cracked and brake fluid cap was replaced by one that didnt fit and slid around letting air into the chamber. I’m not a car guy but have been told that, air in the breaking system isn’t good. Can anyone give me more info?

Brake fluid will absorb water from the air causing big problems in your brake system. Get a correct cap, and have the fluid drained and replaced by a reputable mechanic.

My mom just got a used vehicle and has only had it a few days. The check engine light is coming on, it is idling rough, running rough, the gas gauge doesn’t work right, and other things. Of course when she got the vehicle she didn’t have any problems, it wasn’t until she went to drive it 2 hours HOME that she started to have problems!! Starting with breaking down on the side of the highway because of the broken gas gauge!!

She is wanting to know what her options are. She doesn’t want to mess with it while her husband is telling her it isn’t any big deal that she just needs an alignment and a tune up. That doesn’t sound right and since she just got the car and nothing was wrong with it when she got it shouldn’t the place where she got it should be paying for all that???

Lemon Law in VA is only applicable to NEW car purchase.

Used car should have a specific warranty telling you what’s covered; unless you bought it as is or without one; which should have told you there would be problems.
