question about used car and Virginia Lemon Law?

Question by Ally S: question about used car and Virginia Lemon Law?
So here’s my story, I live in Virginia, on NOV 3, 2010 I bought a used car(1994 Ford Taurus SHO) from a used car dealership, “as is”, no warranty. The car kept dying and smoking, so I took it back about 3 times for them to fix it, because the guy said “if anything is wrong, bring it back and we’ll fix it.” On NOV 19, 2010, they kept the car for 2 days, fixing it, and I picked it up on NOV 20, 2010. On NOV 27, 2010, the car completely broke down, battery died, power steering seized up(i think), and when we called the dealership and told them about what happened and if they’d fix it, they said “no we won’t, because we already fixed it.” Also, the dealer did not give me a “buyers guide”. So does my car fall under the Virginia Lemon Law where I can basically take the car back and say give me my money back, since it hasn’t even been a month since I’ve had the car? Or there something else that can help me get my money back? Please help!!! Thank you so much.
the car I bought is not new, it is USED

You bought a 16 year old car without a warranty. You have little claim against the dealer, much less through the states ‘lemon law’.

I bought a new car(2007) in TX and it keeps breaking down I need to know what my rights are. I have already had to bring it back to the dealer twice to get parts replaced

People in Texas have to go to their home court in Oklahoma City to enact the lemon law since every car sold in Texas is theoretically a lemon.

About Vermont lemon law?

Question by Sheri: About Vermont lemon law?
I bought a car in vt a month and a half ago and it will not pass inspection without. 00 worth of work, on top of dying pretty much every time I drive it. Is there a lemon law that can get my 00 back?

Best answer:

Answer by xx_satanic_mechanic_xx
Nope.

used cars are AS IS. The lemon law will come into play on brand new cars, and used cars still under manufacturer warranty. Since you spent 2800 I am certain your car is neither of these.

This is why we preach: Get a mechanical inspection BEFORE you buy. That 0 inspection could have saved you a lot of $ and hassle.

Now, you may have one ‘out’, depending on the laws in your state. In some state’s, it is the seller’s responsibility to make sure that the car passes the required inspection or emissions test. It’s a long shot for you, being over a month ago. The selelr can say it would have passed had you done the check on the day you bought it, and that it was OK when sold. Check to see what the law is. It wont unwind the deal, but it will make the required repairs the seller’s responsibility

Question by vinster: had my used car about 4 days, brakes making noise now (safety issue.). what can i do?
Making payments on this car i just got , and had it a few days. I’m in the state of Arkansas, and it’s a local used dealer. It’s a seemingly nice 99′ Hyundai Sonata , and a carfax “Lemon Check” turned up positive as nothing filed. Tonight the rear brakes are making a noise , and i believe this is also a safety issue. Can i inform the dealer? What can i make him do if anything? Arkansas has a 30 day lemon law statuate, so …what now?

I don’t believe brake shoes or pads will be covered under lemon laws. It is normal wear and tear. Go somewhere like “just brakes” shouldn’t be that expensive, couple hundred maybe.

Question by kim s: I have a question about a used car that I bought?
Two weeks ago I bought a car from a dealer who buys his car from the auction in NH. I bought the van in MA where I live.. When I bought the car the check engine light was on, the owner said that he would fix it for me for free. Its been almost two weeks since I got the car and the owner i avoiding me. The only was he will talk to me is if I go to his house(35 min away). He told me to call him tomorrow morning because he said he should have the part in that I need. I honestly think that he going to avoid me until the 30 days is up. He told me that I didn’t have to make my first payment until the van passes inspection. What if anything can I do if he keeps avoiding passed the 30 day lemon law?
the thing is that the owner is by best friends uncle so I know who he is thats why I went to him. Also I found out if I bought any car over 0 the lemon law does apply. The code was the idle sensor

Hate to tell you, but lemon laws only apply to NEW cars. Why in the name of little green apples would you buy a car with the light on? The dealer isn’t going to fix it, and if you don’t pay they’ll repossess. Sorry.

Question by mrs.rylee: Does anyone know about the Texas Lemon Law?
Ok So I have this 2007 vehicle and I’ve had problems with it sense day one and it doesn’t even have 40k miles on it. My question is how do you go about filing it as a lemon and how many times does it have to be repaired to file.

Best answer:

Answer by none
If it has been repaired more than 3 times for the same problem during it’s warranty period than it can be considered a lemon.

“Lemon laws” are only for NEW cars, not used. If you have a service contract, have it serviced. If you mean you have a warranty, have it fixed.

that isnt covered under the warranty. It is a 900 dollar fix which I can not afford. Do I have any rights under lemon law?

The lemon law only applies to brand new cars not used ones. What is the problem and what kind of warranty did they give you.

Abyone know about the ny puppy lemon law?

Tagged Under : , , , ,

Question by elizabeth: Abyone know about the ny puppy lemon law?
I bought a puppy from a kennel that ended up having parvo. Now i know the ny puppy lemon law. however i do not wan to return puppy for refund nor do i wan to exchange for new puppy. I do want to keep puppy and care for it and i now the law says the kennel is responsible to cover vet bill for up to price of puppy. now the question is do i have to take it to the vet that they have in order for them to pay the bills? I choose to take to my vet and now the kennel will not pay most of the bill saying that if i took to their vet it would of been cheaper and they would of taken care of all bills. So does anyone know if they are responsible for vet bill being that i took it to my vet or do u know who i can contact to ask this question?
thanks

Best answer:

Answer by Rayven~Summer Troll Patrol
No you don’t have to take it to THEIR vet. THEIR vet would have more than likely not diagnosed the dog with whatever issues your vet found it to have – that is why it would have been cheaper. They don’t get to dictate what vet you use.

Question about “private party” vehicle lemon laws for alaska?

Tagged Under : , , , , , , ,

Question by john: Question about “private party” vehicle lemon laws for alaska?
i just have a quick question. i live in alaska and i did some research, it states that any “used” vehicle sold wether or not it was a dealer or private party had no lemon law warrenty… it says lemon laws only apply to new cars. my problem is i sold a vehicle for my mother in law for 3000 three weeks ago, it was sold for 1k below low blue book and the person who purchased it knew it ticked “it ticked when he test drove it.” and he was well aware that it would need some kind of work… hince the 182k miles it had on it. he just called me telling me he put a timing belt on it and it didn’t fix it and that he wants his money back or he’s taking us to court. unfortunately neither of us had a bill of sale made out so there is no documentation to back up anything. my mother in law turned in the bottom title slip to the DMV that i guess releases her from the ownership and the new buyer is fully responsible from there on out. i guess my question is does he have any ground to stand on in civil court? i regret not making a bill of sale, but still it is his word against mine and that is it.

Best answer:

Answer by Twister
you should always make a bill of sale but you are good if i understand the law right when you buy a used vehicle you buy as is where is the only way that this can be changed is if there was a we owe document made up then you would be responsible for everything that was stated on the document
