Question by nick name: Going through lemon law claim with an attorney, it’s been a while, should I wait or go to another attorney
I’ve got a 2007 Chevy that went that turned out to be trash. Anyway, I found an attorney and gave him my case a few months ago back on June 24 and it took him until August 25 to get a first response/offer from GM which was crap. Basically they offered me less money than my attorney would get in fees and an extended warranty. My attorney agreed that it was crap, so he rejected the offer. The thing is, from June to Aug, he never spoke with me, I always speak to his assistant and when I asked to speak with the attorney, he only promisses me that he will call me back, and NEVER does. So I called on Aug. 25 and told them that if I don’t get a call back from the attorney to find out what in the hell is going on, then I’m going to find another attroney. He then called me back and told me that he got an offer from GM…..what a coincidence, they day I threaten them going to a different attorney, he calls back and gives me this shitty offer, that even he told me not to accept. Back to The waiting game again. Since Aug 25, he hasn’t gotten back to me. Is there something wrong with my lawyer or is this lemon law process normal. What should I do?

Go with another lawyer. OR, call Chevrolet yourself. Sometimes you have to be the bad guy and make waves yourself.

I haven’t paid my attorney anything. He told me that I wouldn’t have to pay anything, and he would get his fees from GM.

get a different lawyer. you’re paying the lawyer to work for you and if he’s not doing that… give him the boot.

There was a case against a women who imports English Bulldogs to the US, sells them, then ships them to you. The problem was there were many sick dogs, that she did this with. There was a contract signed by the owners, myself included. That contract waived the rights of the puppy lemon law for the state she lives in. I was not awar of a puppy lemon law. Well, before I knew about the others going through this, I contacted my court and we went through a couple of trials. They ruled in the favor of me to get paid back the cost of the dog plus all vet bills that occured. I later was contacted by the attorney general’s office stating that they are suing her for her conduct. There were many others going through the same thing I did. I never got paid, she lived in a different state, so it is difficult to send her a capias. She won’t do anything because she knows my sherriff is’nt going to another state to arrest her. Now I recently found out she moved again to a whole different state. How convienent is that? I contact the attorney generals office that has a case open with her, but every time I talk to them they say they are in the middle of talking with her attorney. It’s frustrating, because I lost my dog because of his illness, I put alot into this, and nothing in return. And what pisses me off, is she still does business on the internet making money charging more now than she had in the past. Should I continue with this fight? Or give up and say hell with it. This feels like a loosing battle. I get so mad knowing that she’s still getting away with this today. I Learned my lesson. If it sounds too easy, and too good to be true it’s going to rip you off.

How exactly did you go about it? This car was bought and serviced at the same dealer. Leased in April, ’08. Who do we speak with?
What do we say? What is the procedure, and do they wipe out the lease on it? Please be as specific as possible. Would like to do this tomorrow as next payment is due in < 2 weeks. Don't want to put any more money out on this car!! FYI: We live in Ohio - I know we have a lemon law, but can't afford an attorney!!

It’s under warranty, obviously. You speak to the service manager. What you’ll need to say is “fix it”.
If they can’t fix it, see if you can find a manufacturer’s customer service number and talk to them about it.
What on earth are you doing leasing a brand new car, and then saying you “can’t afford” an attorney? Leasing is for rich people.

if the title has been put back to a rebuilt title, there is probably nothing you can do about it. get a carfax report next time.

This type of claim takes time, you and your attorney are dealing with a corporation that has plenty of time and several lawyers in several countries and they move at a slow pace.
I am aware of a lemon law claim that took over 2 years with the car being parked at a GM dealer until settled.
