What is the process to file a Civil Lawsuit against a company? I bought a car and it is a lemon. Under the NC Lemon Law my car falls under all categories. I have repaired the same thing 4 times and there is no fix for this problem. I have cooperated with the company and dealership to resolve this problem but now the company will not assist me in any way because they know this problem cannot be fixed. Thanks for any advice.

There are two ways:
1. Look in the yellow pages or on the internet for a lemon law lawyer, and hire one. They will be paid out of your recovery.
2. Try to do it yourself and lose.

Lemon laws apply only to NEW cars, so you cannot file a claim.
Second, the BBB has no legal authority to do anything.

I bought a truck for book value. The seller told me there were some minor things wrong with it. She told me there was a small gas leak that her mechanic said was probably a hose. She also said it wasn’t making any puddles. Anyway I had to wait a week for the title after I paid for it so the Massachusetts Lemon Aid Law wouldn’t work since it would have to be inspected within seven days from purchase. I took it into the shop to get it checked out and I needed a fuel sending unit, fuel tank, and the brakes were used till the rotors got warped and the calipers were seized. Anyway it ended up being over 00 in repairs. I sent her a letter to demand she at least cover the fuel leak problem. Anyone driving this would have to know that the brakes were in need of major repair. To not inform the buyer of known defects is fraud isn’t it?

You said anyone driving it would have known about the brakes. Didn’t you test drive it before you bought it? I think you could take her to small claims court. But, if you win they won’t and can’t actually make the person pay. Good Luck! Wouldn’t the lemon law apply to 7 days of you receiving the title? I don’t know how the law is but it should be this way.

I got a Kodak touch screen camera for my birthday (july) that I have taken extremely good care of. The lens of the camera will not go back in which I would consider a defect. When I got the camera we purchased Circuit City’s Advantage Protection plan to accompany the camera because the salesperson sold it to us as being “hassle-free” and better than the manufacturer’s warranty. She told us quote “you can just bring it in and exchange it for a new one if something is wrong with it”. Said plan was supposed to include everything including replacement from accidental damage, loss, theft, and a no-lemon guarantee. Now that we need to replace my camera (we have an engagement party this friday night we will need it for) they are telling us it will have to be shipped out for at least two weeks so it can be repaired. I want to know if I can report them for misrepresentation of their product replacement plan since the salesperson mislead us into purchasing a plan because we believed we could exchange it at the store. I feel the 80 dollars we paid was for that convenice and had we known at the time that we’d have to send it out for two weeks anyway, we’d have just saved our money and used the manufacturers warranty that comes with the camera.
I understand exactly how their warranty works. Since we were lied to about this service and tricked into purchasing it, do I have grounds to file any type of law suit or anything against them for fraud, misrepresentation, or anything else?
I really want to have this situation resolved. I am extremely frustrated and was on the phone for over an hour transferred to three different rude departments and five different people. No one is willing to help and I feel like this is my last resort.
P.S. I already filed a complaint with the bbb and emailed a letter to the vice president of relations but no one seems to care as they haven’t answered.

They did misrepresent the warranty.. but unless you have it in writing what proof are you going to take with you to court? The burden of proof will be on you… you will have to prove it happened the way you said. All the salesperson would have to do is deny it and then it turns into a he said she said and I don’t think it would be something you could win. Push it at the local store, times are tough, they probably don’t want to loose a customer.

Have already filled the lemon law TWO Years ago against maker. High class dealer refuses to fix car. Tired of paying for a new car that I keep oil in, or drive without the engine light on. The dealer has laughted at my problem and said its my problem. Don’t I have rights,and how can they do this to me? I didn’t request a car that has disappearing oil at time of purchase. The dealership is trying to weed out warranty and time is running out. The car has 24 claims on car fax.

Your warranty should cover that. Its not there fault its a lemon, Take it to another dealer of the same make if you have to..
