Question by angela w: How do I file a Civil Lawsuit?
What is the process to file a Civil Lawsuit against a company? I bought a car and it is a lemon. Under the NC Lemon Law my car falls under all categories. I have repaired the same thing 4 times and there is no fix for this problem. I have cooperated with the company and dealership to resolve this problem but now the company will not assist me in any way because they know this problem cannot be fixed. Thanks for any advice.

There are two ways:

1. Look in the yellow pages or on the internet for a lemon law lawyer, and hire one. They will be paid out of your recovery.

2. Try to do it yourself and lose.

I’ve been with my car for about 1+ year and a few months and since I bought it I have been taking it to the dealership multiple times (more than 4) for same reason.

Airbag light on
Sun roof broken
Fixtures such as door handles, paint coming off
Headlights (remaining on when locking with remote causing battery drainage)
Battery (replaced twice due to headlight issue)
Radio (replaced 2 times twice by dealership 1 by me)
TMPS Tire lights on

Contacted folks at Lemon Law and claim had to be opened within 1st year of purchase.
Per them a settlement with dealership could be possible.
I was instructed to take the vehicle again (4th time) and have them repair it.
Provided Purchase order per their request among other financial documents

When I picked up the car, sun roof portion came off there was a part that covers the rail which was missing.
They left the roof on the interior all black (dirty) spoke with service manager and showed him the sunroof.

This is what he said
“Jacob, that is the quality of the sunroof these were made cheap”
I asked him what could be done, he couldn’t respond.

So I get home and lock my car, turn around and sure enough the headlights where on.
Meaning the car was not fixed period and this totals to 4 times. LOL

Air bag couldn’t be fixed as light wasn’t on (security)

I’ve got pictures where air bag lights up, I kept these as I knew these would come in handy as every time I would take the car they couldn’t find anything because the light was not on at the moment. Radio I really couldn’t believe that these people have to call a Tech line in order to fix electrical issues AND THIS IS A DEALERSHIP When I explained the situation (prior replacement of radio) I told them I had taken it somewhere else and was told the radio was heating up as it was missing an amplifier (I bought the car with a Kenwood stereo factory installed 6 speakers) they still replaced the radio 2 times!!!!!!

Among allot of ugly details, all my time spent, my friends time lost (as I needed rides) hours lost at work things of that nature.

My question should I stick with Lemon Law claim? Or should I go with someone else? If I go with someone else what could this be? A lawyer?

I have full details back up, reports from actual dealership with dates and details about every single repair done.
Air bag pictures, the dirty roof deal everything.

All I wanted is my car to be fixed because I love my car yet I don’t think I want it anymore as warranty will expire soon and I will be left with a lemon car….

What do you suggest? If you need further detailed please advise…..

Most lawyers would not accept this lawsuit. Hyundai cars have traditionally sold for lower prices. In return, most car buyers did not expect much for their money. In recent years, Hyundai has tried to switch this perception of them as providing substandard cars and service.

Your only hope would be to prove that Hyundai knew that they were selling a substandard car and that you got cheated. Checking Consumer Reports Magazine ( I don’t work for them) shows that your experience is close to normal. Sunroofs cause lots of problems and should be avoided.

Hang onto the car and use it up.

Lemon law, Pennsylvania or Lawsuit?

I purchased a ‘certified used’ vehicle from a car dealership in my general area 1 year and 6 days ago. The vehicle is a 2002 and had 38212 miles on it when purchased. The vehicle came with a 3 month/4000mi warranty.

Within two days of vehicle purchase car had to be repaired.

Within weeks after that air conditioning had to be repaired.

Few weeks after that a/c had to be repaired again.

After that, a/c was ‘completely rebuilt’ as told to me by head of the service department, who consequently no longer works there.

That was all under warranty.

Car has cost upwards of 1000$ in my out of pocket repairs since December of 08, not counting what NEEDS to be done to it.

Window has failed (est 700$) and since my windows are duct taped shut, a/c is of vital importance.

A/c is no longer functional. Estimated cost of repair 1500-2000$.

Dealership refuses to service the vehicle as the warranty expired and they claim that they only replaced the condenser, which is apparently not the problem.

Mechanic I took my car to, said its a lemon and he wouldn’t be surprised if it was a lemon law buy back that was illegally sold without notifying me (the buyer) of it being a lemon buy back.

I have contacted my local lemon law attorney firm and they claim they cannot help me because of the cars age.

I have had it a YEAR.

Do I have any legal recourse what so ever? This is the FOURTH a/c repair and total repairs made to and needed exceed the price paid AND value of the car combined.

This is in the state of Pennsylvania.
I am referring more specifically to the Magnuson-Moss Warranty Act, or a private civil lawsuit, brought by myself.

Do either of those APPLY?

I know lemon law is for ‘new cars’ only, it is simply a title heading.

i don’t think you do, there is a limit on when you can act and that passed 9 months ago.
