okay.
barely a month ago, 3/13/2010 to be exact, i bought my 97 ford taurus from a certified dealership in dearborn MI
the dealership was selling the car for 2000 dollars, but i talked them into knocking it down a few hundred.
i was at the dealership for a long time checking the car, driving it around, i was going to have a mechanic with me but it was a saturday and there was already another potential buyer coming in to buy it the next day.
now, this “dealership” was more like a piece of crap junkyard that refurbishes cars.
after long discussion, calling of numerous people who know about cars, and asking thorough questions about what could possibly be wrong with this car, the dealers assured me that the car had absolutely nothing wrong with it.
i did know of one thing… the headlights didnt work.
that said, i havent been able to drive at all really. until about 6pm then i head home. and i dont leave the house until 2-3pm. and if i go anywhere, it’s the grocery store or a few places up the road. i have not traveled long distances AT ALL.
a few days after i got the car off the lot, i was sitting in the parking lot of auto zone, because sure enough, the battery died the day i got home with the car.
while i was sitting there, the antifreeze canister exploded, meanwhile on the inside of the car, the hot and cold monitor was at a perfect level in between….
okay, so now we have a coolant problem..
i call the dealer and i say, “look, i know i bought the car and now it’s nothing i can do about it, let me know what the real problem with this car is”
his response
“i didnt really look at the car man we just got it up and running to get off the lot”
and he hung up.
basically admitted to fraudulence.

now, a few weeks after that, and minimal driving because anything longer than 10 minutes on the road the antifreeze explodes, the car is rough! it is rough riding.
i took it to get an analysis at a car shop and here is what all is wrong with it…

rear pads and rotor
struts all the way around
right front sway bar is completely broken to the point if i hit a pothole the tires would be off and i could potentially be killed or someone else could.
right and left inner and outer tire rods
coil
radiator
radiator hose

all of that together, is about 2000-3000 dollars.

and today, i was at the thrift store, and get ready to go home, and the car stops turning over and white smoke came out from the alternator.
and now the alternator is done.

i was just wondering if there is any law that i can get a reimbursement, sue the company, if there is a lemon law against this.

everyone is telling me that the sway bar is a big deal because i am a customer, not a mechanic, i am supposed to trust the dealer in knowing that if i drive the car i am going to be safe. there has to be a law against this fraudulence.
i had no idea any of this was wrong with it, like i said, it drove great off the lot.

please dont be cocky or say any dumb things about ford or how i should have known, i am literally just wondering if there is anything i can do.
i am going t read the laws for myself, but any adivse or knowledge on anyones end can really help.

to be frank, all of these problems did appear out of nowhere, do you think i am like two tracking in the woods trying to ruin the car to get a lawsuit? i am a college student with 2 jobs and i need as much of a break as i can get, and being a customer how am i supposed to know? i didnt know the headlights didnt work until i went to drive it the night i bought it and i couldnt drive.
and lets forget about the lemon law, say i am not qualified… is there anything i can do to take them to court?
is there a potential case against them, to perchance just get them to fix these things for free, or refund my money, or give me a new car, or something? i am willing to just get the car fixed, with the list of things that are wrong with it for free, they missrepresented the car with the ad and they misrepresented it in person by having a quick excuse to everything we pointed out and having no problem lying to our faces saying there is absolutely nothing wrong with the car. i havent drove but 25 miles if that since i bought the damn thing.

In most states you must take the car to a license mechanic before you purchase the item. If you did not than you cannot claim that the lemon law was violated. If you can prove that they misrepresented the car in any way, you may be able to take it back or have a judge reverse the sale. But if not, then your screwed.

It’s sold AS IS.

Some states has a 7 day policy, meaning if you took it to a mechanic within 7 days then you can declare it a lemon. However, we wouldn’t know this if we don’t know you state.

My husband is military, we are Florida residents, we bought the truck in North Carolina, it’s registered in NC but we live in GA. It’s headed back to the dealership today to be repaired for the 3rd time in 3 weeks for the same symptom.

So here’s my story, I live in Virginia, on NOV 3, 2010 I bought a used car(1994 Ford Taurus SHO) from a used car dealership, “as is”, no warranty. The car kept dying and smoking, so I took it back about 3 times for them to fix it, because the guy said “if anything is wrong, bring it back and we’ll fix it.” On NOV 19, 2010, they kept the car for 2 days, fixing it, and I picked it up on NOV 20, 2010. On NOV 27, 2010, the car completely broke down, battery died, power steering seized up(i think), and when we called the dealership and told them about what happened and if they’d fix it, they said “no we won’t, because we already fixed it.” Also, the dealer did not give me a “buyers guide”. So does my car fall under the Virginia Lemon Law where I can basically take the car back and say give me my money back, since it hasn’t even been a month since I’ve had the car? Or there something else that can help me get my money back? Please help!!! Thank you so much.
the car I bought is not new, it is USED

You bought a 16 year old car without a warranty. You have little claim against the dealer, much less through the states ‘lemon law’.

People in Texas have to go to their home court in Oklahoma City to enact the lemon law since every car sold in Texas is theoretically a lemon.

Ok I sold a 93 honda civic and it ran great I got it in a trade. I sold it to these girls who each drove it around I explained that I thought it had an exhaust leak but that I had not training to know for sure. She bought it for 2000 on Feb 25 it is now March 7 and just now shes telling me that the motor blown or somethings really wrong Im not sure. Today I got home and there was a note in the door saying that that they want there money back or they would be going to the police or a layer. Im just wondering ive done some research about it and know that the lemon law only covers from dealerships and I honestly sold them a good car. I also wrote a bill of sale stating that i was selling the car and she was the buyer. Im just wondering to cover my base that this case really wont stand up in court. Any advice would help thanks guys.
so today i got a summon to be at court. I have 20 days to appeal this and give my side which I dont owe her anything if i was getting the running car back id prolly take it back however the engine is blown and the engine is now out of the car. I can also make a counter claim? Does anyone have experince in this? Because i really dont want to lose this case. And she is also stating that i sold her a non working car and said there was nothing wrong with it. SHE DROVE IT HOME.
anyone also got a data point i can print out and show to the judge to show that there is no lemon law for cars that are used and private party just so i can bring proof chances are this judge isnt the greatest.

There is no lemon law that covers used cars, and certainly not cars that are almost 20 years old. They have no case whatsoever.

hi i just bought a brand new 2009 toyota tundra, (7 months ago) since i got the truck my stereo turnes on and off when ever i hit a bump in the road, i sent it in for repairs 4 different times already, and the problem still occurs, does this qualify under the lemon law, and am i entitled to a new car?

I think this would be considered rather minor when looking at the BIG picture.

A true lemon is a car that you cannot depend on to get you to work. One that is in the shop for major repairs often. A radio doesn’t keep you home from work……..

My laptop’s motherboard has fried three or four time in the last year. My warranty allows me to keep getting it fixed free of charge, but as my warranty gets closer to the end of its life, I dont want the laptop back knowing the motherboard will most likely fry again. Can I use the lemon law to help me get a new laptop?

I bought a car in Az from a private owner for $ 2100 and all seemed fine but on driving it to Nashville for my internship it stopped working suddenly in Texas, and now I am being told it will cost $ 4500 to fix/install it, as it needs a new engine. There was oil in it and according to my uncle no oil leak,but the mechanic said likely an oil shortage ruined the whole cylinder 4 (its a 2001 ford focus). I want to know if I am entitled to my money back as stated under the used car section of the lemon law for Az since it stopped working on day 3. Thank you for any help!

The “lemon law” is for new vehicles only. You bought a used vehicle as-is from a private party. You don’t say how many miles are on it or if you had a shop inspect it prior to purchase. If you had chances are you may have found some defect, but no guarantee you would have. Whoever quoted the $ 4500 for a replacement engine has bumped their head. Get other estimates.

Be prepared for a difficult journey – it’s not as easy as you might hope to get a car classified as a lemon.
A couple of threshold requirements:
the care has to be a PURCHASE (leases don’t count), and
you must have owned the car fewer than eighteen months, and
you must make your first complaint within the first year of ownership.

The complaint must be direct to the manufacturer, not to the dealer, and you must have had either four or more repair attempts OR the vehicle must have been out of commission for 30 or more calendar days.

Assuming you meet all of those tests… then you must submit to dispute resolution with the manufacturer.

There’s no fees that the law requires or imposes, but there are a lot of people out there who will offer to take your money to arbitrate with the manufacturer for you.

Bottom line, if you didn’t have four or more repair attempts or thirty days of out of service for the same complaint, don’t waste your money trying to pursue a lemon law claim…
