So I “traded” a car on Craigslist last week… It was my husbands pride and joy he LOVED it. We have 2 children and the car he had didn’t have any backseats so I made him put it on craigslist. We found a guy who had another car that had backseats and he “test drove” it around the parking lost of the mans work. No Problems. We did the trade and on our way home the car started messing up. The car has so much work that needs to be done with it that it would cost MORE to fix the car than buying a new car… So we are SOL. So we get on craigslist tonight and see that the man who we “traded” cars with is now SELLING my husbands car that we just traded. (Also asking way more than the car is worth). We have been trying to call him for DAYS because the car is in so much bad shape that we figured that there was some kinda of Lemon Law that would validate us getting our car back.. however the man would not answer the phone. My husband is heated that now that the man is selling our old car on Craigslist less than a week later and we want our car back since his car was defective. I plan on going to a lawyer but do I have a lawsuit? Or am I just wasting my time.
The guy answered the phone once when we called the day after the car messed up and basically told us sorry he “didn’t know” there was an issue but we were basically SOL.. Is there anyway we can prevent the guy from selling the car while we are working with a lawyer to get our car back? The car is in such bad shape (the one we received in the trade) that we haven’t even had a “change of title” yet because of the condition the car is in.
Im just so stressed. We traded the car so my husband could help take my kids to dr appointments (my son is sick and spends most of his time in hospitals and dr appointments) and I just feel like I was robbed. I hope there is something I can do to get my husbands car back due to the fact that the man sold us a lemon car.

bad lemon, contact the dmv and report the issue, talk to a lawyer, usually what will happen is if you bought the car and still paying is, 1. get your money back 2. keep the car as in and paid in full. trade? not sure how that will work out.

I know the Lemon’s law is only for new or leased cars, but is there a law for used cars. What if da owner tell u there is nothing wrong with the car and you buy it and it stops working can you sue for your money back

A used car isn’t covered under the Georgia lemon law. You should consult with an attorney regarding whether or not you would have grounds to sue otherwise.

The New York Lemon Law for used cars states that a used car is considered:
“if it was purchased, leased or transferred after the earlier of a) 18,000 miles of operation or b) two years from the date of original delivery”
The car I’m looking into buying is a 2003 Chevy Cavalier with 6,280 miles. I was wondering if the vehicle would be covered under the lemon law. It just seems a little strange to me that a 7 year old car has less than 7K miles on it. What do you guys think?

The “lemon laws” refer to vehicles that need to be repaired for the same reason for repeated times, like a problem with an engine that cannot be repaired after XXX amount of times in the repair shop – the lemon laws would not be in affect for the vehicle you are looking at….it is possible that someone bought it new and drove it very little….a Carfax or Autocheck can be purchased to verify the owners low mileage claims

Okay, so I live in mississippi and a couple months ago I traded my 92 celica to a girl for her 99 eclipse. Two weeks later it turns out that the celica’s motor throws a rod, when her mechanic examined the engine, it turns out to be because of overtightened bearings or something from when it had previously been rebuilt, and they’re threatening to sue me.
I had no clue that the engine had even been rebuilt, I assume that it was the owners before me who rebuilt it. And the car had always run great for me.
Can they do anything to me?
Also, on the flip side, the transmission ends up going out on the car I got. When test driving it was jerking a little but she claimed it to be a bad motor mount, so after I got the bad mount replaced, it still did it and turned out to be the transmission.

Lemon laws only refer to new cars, not used cars. If they can prove you know about the problem prior they can sue, but if they can’t prove that, they have no case as used cars and sold as-is

I just purchased a 2001 dodge durango out of vermont state for almost 5 grand….no warrenty..i know stupid on my part..well i have had it for literlay 24 hours and just found out it needs like 2 grand or more done to it for transmision issues…im unsure what vermont state lemon law is and am looking for any insight or possibly neone who has been through a similar problem. thanx
the macheine at the garage says its the torque converter clutch….they recomended to flush the transmision lines and then go from there….

try this ,ask the mechanic if they are sure that will fix it because if not that will just be more money wasted on it,i wish you has said what it was doing or not doing,take it to a transmission shop because they are more qualified to diagnose it than a regular repair shop is,the flush may not help this one,so make sure they know what their talking about before they do it,good luck.

My mom just got a used vehicle and has only had it a few days. The check engine light is coming on, it is idling rough, running rough, the gas gauge doesn’t work right, and other things. Of course when she got the vehicle she didn’t have any problems, it wasn’t until she went to drive it 2 hours HOME that she started to have problems!! Starting with breaking down on the side of the highway because of the broken gas gauge!!
She is wanting to know what her options are. She doesn’t want to mess with it while her husband is telling her it isn’t any big deal that she just needs an alignment and a tune up. That doesn’t sound right and since she just got the car and nothing was wrong with it when she got it shouldn’t the place where she got it should be paying for all that???

Lemon Law in VA is only applicable to NEW car purchase.
Used car should have a specific warranty telling you what’s covered; unless you bought it as is or without one; which should have told you there would be problems.
