So here’s my story, I live in Virginia, on NOV 3, 2010 I bought a used car(1994 Ford Taurus SHO) from a used car dealership, “as is”, no warranty. The car kept dying and smoking, so I took it back about 3 times for them to fix it, because the guy said “if anything is wrong, bring it back and we’ll fix it.” On NOV 19, 2010, they kept the car for 2 days, fixing it, and I picked it up on NOV 20, 2010. On NOV 27, 2010, the car completely broke down, battery died, power steering seized up(i think), and when we called the dealership and told them about what happened and if they’d fix it, they said “no we won’t, because we already fixed it.” Also, the dealer did not give me a “buyers guide”. So does my car fall under the Virginia Lemon Law where I can basically take the car back and say give me my money back, since it hasn’t even been a month since I’ve had the car? Or there something else that can help me get my money back? Please help!!! Thank you so much.
the car I bought is not new, it is USED

You bought a 16 year old car without a warranty. You have little claim against the dealer, much less through the states ‘lemon law’.

lemon laws do not cover used vehicles in any state (the only possible exception is California but even then it won;t from a private seller)

Hi, my brother is actually the one who bought a 91 Camaro off Ebay last week. The listing stated that everything with the engine and transmission were in perfect working order. We live in NY and the dealer was in PA. He drove down to pick it up and before even leaving the state noticed that the car was stalling and had to change the alternator to be able to make it home. After getting it home he found many more problems wrong and now the seller isn’t being cooperative at all. What are his option at this point? He clearly bought a dud but was completely led to believe that everything was fine with this car. I know NYS has a lemon law but it doesn’t apply to cars bought in another state, is there a used car lemon law for cars purchased bye a PA dealer? Any help would be appreciated

Most lemon laws don’t apply to vehicles over 10 years old or 100,000 miles. If the car was obviously mis-represented you should be able to take the dealer to small claims court and recoup your money.

Question by vinster: had my used car about 4 days, brakes making noise now (safety issue.). what can i do?
Making payments on this car i just got , and had it a few days. I’m in the state of Arkansas, and it’s a local used dealer. It’s a seemingly nice 99′ Hyundai Sonata , and a carfax “Lemon Check” turned up positive as nothing filed. Tonight the rear brakes are making a noise , and i believe this is also a safety issue. Can i inform the dealer? What can i make him do if anything? Arkansas has a 30 day lemon law statuate, so …what now?

I don’t believe brake shoes or pads will be covered under lemon laws. It is normal wear and tear. Go somewhere like “just brakes” shouldn’t be that expensive, couple hundred maybe.

Im in New Mexico. My hubby and I have a truck that weve had for 10mos and already had the transmission rebuilt, a new engine put in a many more problems.
We bought it from a large dealership in albuquerque. Zangara dodge.

I recently purchaced a privately owned used car and it is having problems. The guy who sold me the car misrepresented is and sold it to me under false pretence. Now I want to return the car for my money back and he is giving me the run around and telling me lies like he’s out of the country and he doesn’t have the money. When I purchased the car he said it haden’t been in any accidents and he up kept the car. I purchased a carfax report after i purchased the car because I didn’t want him to sell it to anyone else, and found out it was in a front end collision and received major damage. He also did not up keep the car because when I had it inspected it was low on all of the fluids and the engine was starting to suffer. I’m not exactly sure what to do. I’m thinking about taking him to court, but i’m not sure if this falls under any Maryland Lemon laws.

not much you can do since you did all this after buying it always need to check those things before buying that’s why thy say buyer beware

About 3 weeks ago, I purchased a used lexus as-is. The tranny went out 2-3 weeks later. Am I protected in any way? Let me know if you need more info.

Since it was sold “AS-IS” then no warranty was implied. I think that you are on your own with this one. good luck.
